The Mel Tucker lawsuit is an attention grabber. The complaint lists a litany of claims, and implicates not only institutional failings but also revisits allegedl past misdeeds by individuals. If the case proceeds normally through the system it will be messy on a number of fronts, especially given that Tucker claims that his reputation has been damaged. Fully expect MSU will attempt to label Tucker “defamation proof”; incapable of having his reputation harmed.

MSU begins this conflict with a history of poor management of a litany of sexual abuse/harassment matters.

Unfortunately it looks like MSU is developing a history of screwing people like Tucker, Rema Vassar and other Black faculty and staff??

In the pursuit of justice, Law Firm is thrilled to share the remarkable story of our recent success in the OUI case of State v. K.L., where the odds were stacked against us, but justice prevailed. Our client, a Massachusetts resident, found himself in a challenging situation when stopped by Kennebec County Sheriff’s Department Deputies for what they deemed as unusual operation. The client's operation was deemed unusual because he had reversed direction a couple of times on Interstate 95, a highway known for its numerous Augusta exits. Our client's testimony showed that the exits were numbered differently than the last time he drove in Maine.Despite the Deputy's insistence, our client's field sobriety tests were not poor; rather, he failed to follow instructions.Despite Maine not allowing the arrestee to choose the type of chemical test, our client firmly refused the breath test. He believed that a blood test was more reliable, and he was determined to stand his ground. In the end, our unwavering dedication to our client's rights and our commitment to justice prevailed. The verdict? NOT GUILTY!Learn more about this case... http://bit.ly/State-vs-KLIf you or someone you know is in need of legal representation, remember that we are here to stand by your side, just as we did for K.L.🌐 To learn more about our exceptional legal services, visit our website: www.nicholstucker.com.Contact us today for a confidential consultation and put our expertise on your side!...#JusticePrevailed #OUIVictory #NicholsTucker #LawFirm #DUIDefense #NotGuilty #LegalVictory #Justice #OUI #DUI

Here's my newest blog - this one showing why an otherwise obscure securities law case could be used by the Supreme Court in its next term to do serious damage to relatively independent administrative agencies, including the SEC as well as other agencies charged with law enforcement. I also diagnose the rising influence of illiberal "common good" legal and political theories as particularly worrisome and requiring effective response. Hint: they are not actually "good"!https://lnkd.in/eV6G_TFf#securitieslaw #securitiesregulation #administrativelaw #constitutionallaw #politicalscience #commongood #sec

The interesting feature for regulators is not the mandatory duty to report treason, but that reports filed to intimidate or harass another registrant is, in itself, professional misconduct: https://lnkd.in/gadzErm3 #professionalregulation

For years, federal prosecutors categorized individuals subpoenaed to testify before federal grand juries as either “Targets,” “Subjects,” or “Witnesses.” However, recently, prosecutors have abandoned the “Witness” categorization—which was once assigned to individuals who were fact witnesses and not suspected of criminal behavior—and have chosen instead to label these likely-guiltless parties as “Subjects.” In our article, we discuss some of the challenges and inequities caused by this shift in DOJ practice, particularly for lower-income individuals who likely lack the resources to navigate the timely and costly subpoena process. Our solution: DOJ should redefine the “Witness” designation so that a fact witness knows he is, indeed, just a "Witness."G. Zachary Terwilliger, Brittany Harwood, Alex Rant
